1. Introduction

Welcome to New Wave Lawyers (“we”, “us”, “our”). We are committed to protecting the privacy and confidentiality of personal information that we collect from prospective clients, clients, and visitors to our website. This Privacy Notice explains how we collect, use, disclose, retain, and dispose of personal information, including when you visit our website or engage our legal services.

2. Scope of this Notice

This Notice applies to:

  • Personal information you provide to us in connection with a potential or actual engagement of legal services (employment, business, privacy, or immigration law).

  • Personal information we receive when you contact us (by email, phone, or website form) or otherwise provide information to us.

  • Information automatically collected when you visit our website (see Section 6 below).

3. What personal information we collect

We may collect, depending on the circumstances, the following categories of personal information:

  • Contact details: name, address, telephone number, and email address.

  • Identification, employment, or immigration information: such as employer, job title, immigration status, passport/visa/permit information, or business ownership information.

  • Matter-related information: facts, documents, and other information you provide to enable the provision of legal advice or representation (which may include sensitive or confidential information).

  • Website/visitor information: such as IP address, browser type, geographical location, device type, and anonymised usage analytics (see Section 6).

We collect only the personal information necessary to provide legal services, respond to an inquiry, or otherwise perform our professional functions.

4. How we use your personal information

We use your personal information for the following purposes:

  • To respond to your inquiry and determine whether we can provide legal services to you.

  • To provide legal advice and representation, perform our retainer engagement, communicate with you, and fulfil our contractual and professional obligations.

  • To maintain our records and manage client relationships (including reporting, billing, and internal administration).

  • To host and manage our website and improve our services, including anonymised analytics of website usage (see Section 6).

We rely on appropriate legal bases for processing your personal information, such as the performance of a retainer or contract, compliance with legal and professional obligations, your consent (where relevant), and our legitimate interests (for example, maintaining records or improving our website), always taking into account your rights and expectations.

5. SMS and Text Messaging Communications

Where you provide your mobile phone number and consent to receive SMS messages from New Wave Lawyers, we may use text messaging to communicate with you regarding your legal inquiry, consultations, appointment scheduling, document requests, and matters related to the provision of legal services.

You may opt out of SMS communications at any time by replying STOP, and you may request assistance by replying HELP.

Mobile opt-in information is not sold, rented, or shared with third parties for marketing or advertising purposes.

6. Disclosure of personal information

We may disclose your personal information as follows:

  • To third-party service providers (for example, IT or administrative support, secure document storage) who act on our instructions and are bound by confidentiality obligations.

  • To the firm’s designated staff (such as clerks and paralegals) when required to provide you with legal services.

  • To regulatory or governmental authorities when required by law, court order, or professional obligations.

We do not sell or rent personal information to third parties for marketing or unrelated purposes. We do not share mobile phone numbers or SMS opt-in data with third parties for marketing purposes.

7. Website usage, analytics, and cookies

When you visit our website, we and/or our service providers may automatically collect certain usage data (e.g., IP address, device type, browser type, referring or exit pages, time/date stamps, click-stream data) to understand how the site is used and to improve our services. This information is collected in anonymised or aggregated form and cannot reasonably identify you.

If cookies or tracking technologies are used that collect personally identifying information, we will clearly notify you and, where required by law, obtain your consent.

Your use of our website constitutes acceptance of this collection of anonymised usage data, subject to any cookie banner or consent mechanism displayed on the site.

8. Data retention and disposal

We retain personal information only as long as necessary to fulfil the purposes described in this Notice and to comply with professional, contractual, and legal obligations.

With respect to client files or information you provide for legal services, we retain the information for the duration of the engagement and for one (1) year following the end of the engagement or one (1) year of inactivity (no further engagement or communication). After that period, we securely dispose of or anonymise the personal information in accordance with our retention policy, unless a longer retention period is required by law or professional rules.

For anonymised website usage data, retention is only as long as needed for analytics purposes and does not involve identifying you.

9. Security of your personal information

We maintain appropriate technical, administrative, and physical safeguards to protect personal information against unauthorised access, disclosure, alteration, or destruction. Access is limited to those employees or agents who require it to carry out their duties.

While we strive to protect your information, no method of transmission over the internet or electronic storage is completely secure. If you choose to send us information electronically, you do so at your own risk.

  • The right to object to or restrict certain processing, such as direct marketing, where applicable.

  • Where processing is based on consent, the right to withdraw your consent at any time (without affecting the lawfulness of prior processing).

If you wish to exercise any of these rights, please contact us using the details in Section 11. We will respond in accordance with applicable law. In some cases, we may be required by legal, regulatory, or professional obligations to retain certain information.

11. International transfers

Where your personal information is transferred to or processed by service providers located outside Canada, we will take reasonable steps to ensure that your information remains appropriately protected (for example, by contractual safeguards or requiring comparable standards). We will comply with applicable cross-border data-transfer rules under Canadian law or other relevant legal regimes.
